Emptor to Informed Consent:
The Professionalization of
Mortgage Lending
Loan
originators and mortgage
brokers will learn how they
are part of an emerging
profession. This raises
questions about the
difference between the
traditional retail standard
of caveat emptor and
professional duties of
informed consent. By
carefully delineating the
difference between
non-professionals and
professionals, we can begin
to analyze the important
values and virtues that will
bring the industry into a
more fully professionalized
status. As a part of the
class, students will learn
how other professional
groups, i.e., doctors,
lawyers, and CPAs, are
charged with higher ethical
duties than are
non-professionals.
